In a dramatic turn during the Senzo Meyiwa murder trial, presiding Judge Ratha Mokgoatlheng issued a public apology on Monday after a racially charged courtroom outburst triggered widespread condemnati
The incident unfolded when defense advocate Charles Mnisi requested time off to participate in the Comrades Marathon. Mokgoatlheng responded with a remark that ignited controversy:
“This is what happens in a South Africa run by blacks. I can tell you now, even if you call me Uncle Tom, I don’t think a white advocate would have the gall to ask me that. Never.”
The backlash was swift. The Law Society of South Africa and Parliament’s Justice Committee condemned the judge’s statement, calling it racially divisive and damaging to the integrity of the judiciary.
Facing mounting pressure, Mokgoatlheng addressed the nation with a remorseful apology, calling his words “questionable and incorrect.” In a candid admission, he credited his wife for urging him to apologize:
“My wife said I should apologize. She said what I did was worse than what some lawyers are accused of.”
A former anti-apartheid activist and 26-year veteran of the bench, Mokgoatlheng denied any racist intent, calling the accusations “hurtful and untrue.” However, he acknowledged the harm his words caused and offered to recuse himself from the high-profile trial if the accused questioned his impartiality.
This is not the first time the judge has faced public scrutiny. In March 2024, he issued a similar apology after making disparaging remarks about the professionalism of black lawyers.
