In a bold legal move, civil rights group AfriForum has filed an urgent application in the High Court, challenging the constitutionality of the newly enacted Expropriation Act. The organization argues that the legislation poses a serious threat to property rights and could open the door to arbitrary expropriation by the government.
AfriForum contends that the Act lacks sufficient safeguards and undermines the security of ownership enshrined in the Constitution. The group is urging the court to intervene before what it calls a βdangerous precedentβ is set for landowners and investors across South Africa.
βThis law, if left unchallenged, could be weaponized to seize property without fair compensation or due process,β said AfriForumβs legal spokesperson.
