Controversial figure Dr. Nandipha Magudumana has taken her legal battle to the Constitutional Court, arguing that her dramatic return to South Africa from Tanzania was unlawful and amounted to a “disguised extradition.”

Magudumana, the alleged accomplice of convicted rapist and murderer Thabo Bester, contends that her removal from Tanzania in April 2023 violated international law and South Africa’s own extradition protocols.

“Her constitutional rights were trampled. What took place was not a deportation — it was a forcible and illegal rendition,” her legal team argues.

Magudumana and Bester were arrested in Tanzania after fleeing South Africa following Bester’s audacious escape from the Mangaung Correctional Centre, where he faked his own death.

While the state claims she was legally deported, her lawyers insist that:

  • No official extradition process was followed
  • There was no hearing or legal review of her removal
  • The deportation was carried out with covert cooperation between SA and Tanzanian authorities, sidestepping legal channels

Magudumana is asking the Constitutional Court to rule that:

  • Her removal was unlawful and unconstitutional
  • All proceedings against her should be declared invalid or stayed
  • She should be released immediately from custody
