The National Prosecuting Authority (NPA) has formally appealed the controversial decision to grant bail to 12 South African National Defence Force (SANDF) soldiers accused in the brutal murder of Hawks investigator Lieutenant-Colonel Frans Mathipa.
The soldiers were released on R10,000 bail each following their initial appearance at the Randburg Magistrate’s Court—an outcome that sparked national outrage due to the seriousness of the charges, which include murder, kidnapping, fraud, and obstruction of justice.
Unwilling to accept the ruling, the NPA swiftly escalated the matter to the High Court, arguing that the accused pose a serious threat to public safety and could interfere with the investigation if allowed to remain free. The appeal was formally heard today, 17 July 2025, as the state pushes for the accused to be remanded in custody pending trial.
Public interest in the case has surged, with widespread calls for accountability and justice for Lieutenant-Colonel Mathipa, whose death sent shockwaves through law enforcement and civil society. Many have voiced concern over the potential abuse of power by state officials and the need for the judicial system to send a strong message.
