The Durban Magistrate’s Court fell into a tense silence on Monday as Magistrate Kevin Broughton delivered a long-awaited decision in the case of brothers Ferrel and Darren Govender. Arrested in connection with the brutal murder of Umhlanga businessman Shailen Singh, the brothers faced starkly different outcomes—Ferrel was denied bail, while Darren was granted it.
The arrest of the Govender brothers on January 1, 2025, sent shockwaves through the community. Just days earlier, on December 29, 2024, 32-year-old Singh was gunned down in a parking lot on Meridian Drive, Umhlanga. Singh had told his family he’d be home in 15 minutes, but he never made it. His car was riddled with bullets, and he died at the scene, leaving his family devastated. “He said he’d be home soon,” recalled his father, Pradeep Singh, struggling to make sense of the senseless violence.
In his ruling, Magistrate Broughton stated that Ferrel failed to provide exceptional circumstances that would warrant his release. The State had strongly opposed bail, arguing that the brothers posed a risk of interfering with witnesses and evading trial. This was a Schedule 6 bail application—the most serious category under South African law, reserved for grave crimes like murder, where the burden of proof lies heavily on the accused to demonstrate why they should be released.
The allegations against the brothers are both shocking and personal. The State claims that Singh’s murder was fueled by an affair between him and Ferrel’s girlfriend. Adding to the weight of the accusations, CCTV footage allegedly placed both Ferrel and Darren at the scene of the crime. Moreover, cellphone records purportedly show communication between Ferrel and Singh just minutes before the fatal shooting.
